NOTICE OF AMENDMENT

TO: All Concerned Persons

1. On November 3, 2023, the Department of Public Health and Human Services published MAR Notice No. 37-1031 pertaining to the public hearing on the proposed amendment of the above-stated rules at page 1528 of the 2023 Montana Administrative Register, Issue Number 21. An amended notice of public hearing was published on December 8, 2023, at page 1737 of the Montana Administrative Register, Issue Number 23.

2. The department has amended the following rules as proposed: ARM 37.87.703, 37.87.903, 37.87.1011, 37.87.1410, and 37.106.1916.

3. The department has thoroughly considered the comments and testimony received. A summary of the comments received, and the department's responses are as follows:

COMMENT #1: One commenter requested clarification on the table that outlines services that may not be provided concurrently in the proposed Children's Mental Health Bureau Medicaid Services Provider Manual which states Therapeutic Group Home and CBPRS may not be provided concurrently.

RESPONSE #1: The department has reviewed this section of the manual, and we thank the commenter for bringing this to our attention. The table in the manual has been updated to reflect that group community-based psychiatric rehabilitation and supports (CBPRS) may be provided concurrently with therapeutic group home services.

4. The department intends to apply the above-stated rule amendments retroactively to May 12, 2023.
