(1) Upon receipt of a
request made pursuant to 20-4-110(2), MCA and ARM 10.57.601, the board of
public education shall implement an investigation to determine whether or not a
substantial reason exists to hold a hearing for the issuance of a letter of
reprimand or the suspension or revocation of the teacher, specialist or
administrator license. This investigation shall include notifying the affected teacher, specialist or
administrator of the charges against him/her by certified mail and allowing
him/her 10 days to respond to those charges. After receiving a response, the board may request further information to
ensure the preliminary investigation properly reflects the facts and position
of each party.
