(1) Every individual applying for a permit to practice or renewal thereof must submit a statement to the board which describes the individual's level of association with financial statements. This statement shall disclose the practice unit, if any, of which the permit holder is a member. This statement shall be used to determine if the permit holder is required to comply with ARM 24.201.1107.
(2) Permit holders shall be required to file a report with the board as set out in ARM 24.201.1107, along with the required fee set forth in ARM 24.201.410, if they:
(a) sign reports which indicate an expert knowledge of accounting or auditing;
(b) allow their name and designation as a CPA or LPA to be included on a report that indicates expert knowledge of accounting or auditing; or
(c) are members of a practice unit and have the final authority to issue a report that indicates an expert knowledge of accounting or auditing.
(3) Permit holders shall not be required to file a report with the board as set out in ARM 24.201.1107, if they:
(a) do not sign reports which indicate an expert knowledge of accounting or auditing;
(b) do not allow their name and designation as a CPA or LPA to be included on a report that indicates expert knowledge of accounting or auditing; or
(c) are members of a practice unit but do not have the final authority to issue a report that indicates an expert knowledge of accounting or auditing.
(4) In unusual circumstances, the board will decide whether a report is required to be filed under ARM 24.201.1107.
