(1) An applicant submitting a Montana air quality permit application, as required in ARM Title 17, chapter 8, subchapters 7, 8, 9, or 10, shall submit an application fee as provided in (1)(a) and (b):

(a) $3,000 for an application subject to the provisions of ARM Title 17, chapter 8, subchapters 8, 9, or 10 for a facility for which the department has not previously issued a Montana air quality permit; or

(b) $500 for an application not included in (1)(a).

(2) An applicant submitting one or more of the following air quality operating permit applications, as required in ARM Title 17, chapter 8, subchapter 12, shall submit an application fee of $500 for each application as follows:

(a) an application for a new air quality operating permit;

(b) an application for an air quality operating permit renewal; or

(c) an application for a significant modification to an air quality operating permit.

(3) An air quality permit application is incomplete until the proper application fee is paid to the department.

(4) An air quality permit application fee is separate and distinct from any air quality operation fee required to be submitted to the department pursuant to ARM 17.8.505.

(5) Concurrent with submittal of a registration form, as specified in ARM 17.8.1701 through 17.8.1705, the owner or operator shall submit a registration fee of $500.
