(1) If after an
inspection the department determines that violation of the act or this
subchapter is occurring, it shall notify the licensee of the nature of the
violation.
(2) Depending on the severity of the violation,
the department may seek a compliance schedule from the applicant or initiate
proceedings to revoke the license. The
department may also, through the attorney general or appropriate county
attorney, seek to enjoin the licensee, or collect a criminal penalty.
(3) The department may seek a civil penalty from
persons who store, treat, transport or dispose of waste in violation of this
subchapter or Title 75, chapter 10, part 2, MCA.
