NOTICE OF REPEAL OF EMERGENCY RULE

 

            TO: All Concerned Persons

 

1. On June 16, 2022, the Department of Fish, Wildlife and Parks (department) adopted an emergency rule closing the Stillwater River within Stillwater County to all public occupation and recreation in Notice No. 12-571, which was published at page 1044 of the 2022 Montana Administrative Register, Issue No. 12. Severe flooding and dangerous conditions existed in the Stillwater River including downed powerlines and other structures.  It was possible for other obstructions to fall into the Stillwater River due to erosion of the riverbank causing the banks to become unstable. Persons recreating on the river would be at risk of electrocution, injury, or drowning due to collision with unexpected obstructions in the river. The situation constituted an imminent peril to public health, safety, and welfare to anyone using the river.

 

2. As this situation no longer constitutes an imminent peril to public health, safety, and welfare, the department is repealing NEW RULE I STILLWATER RIVER IN STILLWATER COUNTY EMERGENCY CLOSURE.

 

3. The repeal of NEW RULE I is effective August 8, 2022.

 

4. The special notice requirements of 2-4-303, MCA have been met. All committee members and staff of the Environmental Quality Council, with addresses provided on the Montana Legislature's website (leg.mt.gov), were contacted by e-mail on August 8, 2022.
